EU REGULATION ON CHILD SEXUAL ABUSE: ISPA POSITION

The European proposal on preventing and combating child sexual abuse (CSAR) aims to strengthen the EU’s ability to fight online child sexual abuse. ISPA Belgium and its members fully support this goal and are committed to making the digital space a safe environment for everyone.

However, ISPA raises concerns about the operability of the proposal, in particular regarding the protection of end-to-end encryption, the lack of a prevention-led approach, and the disproportionate impact on certain service types such as number-based interpersonal communication and cloud services. ISPA calls for a balanced and workable framework that protects both children and the fundamental rights of all users.

ISPA POSITION NOTE ON TANK INTEGRATION UNDER E-EVIDENCE 

The European e-Evidence Regulation seeks to streamline cross-border access to electronic evidence. ISPA Belgium supports this goal of enhanced cooperation and faster data access for law enforcement, but stresses the importance of building on secure and trusted national systems.

In Belgium, the TANK platform is already used by all telecom operators to handle judicial data requests efficiently and securely. ISPA Belgium therefore calls for the integration of the TANK platform into the EU’s decentralized IT system for e-evidence, ensuring continuity, avoiding duplication of costs, and maintaining operational efficiency.

The EU Payment Services Regulation is currently being discussed within the Council of the European Union and might extend the liability for online fraud to electronic communication services.
